As insuficiências legais relativas ao trabalho da mulher e o tratamento igualitário no Brasil

Abstract

Brazilian women continue to be treated in an unequal and discriminatory manner, due to historical and cultural reasons, as well as the lack of equal treatment of gender in the domestic legal order. This study aims to analyze these legal shortcomings related to the formal work of women, as well as the equal treatment in Brazil. For this, first, the factual context of female labor in Brazil is analyzed; In the second phase equal opportunities and the prohibition of gender discrimination are examined in the context of International Human Rights Law and the internal legal order; Finally, the inadequacies of labor and social security laws are analyzed with regard to gender equality, considering that the regulation of women's work shows flaws in the fair and equal insertion of this collective of women in the labor market. The research is bibliographical and uses national and international authors, as well as readings and research in books, magazine articles, official websites and national and international legislation.
